Dear Dr. Ladner,
This letter is to inform you that the investigation into the Committee to Elect
Darcey Ladner is complete. Pursuant to N.C.G.S. § 163-278.22(7), it is the duty
of the North Carolina State Board of Elections (“NCSBE”) to investigate alleged
violations of Chapter 163, Article 22A of the North Carolina General Statutes.
N.C.G.S. § 163-278.10A permits a candidate committee to be exempt from filing
regular disclosure reports so long as the committee does not receive or spend
more than $1,000 in the election. If the intent to stay within the threshold changes,
or if the one-thousand-dollar ($1,000) threshold is exceeded, the treasurer shall
immediately notify the Board and shall be responsible for filing all reports
required under the applicable reporting statute. See N.C.G.S. § 163-278.10A.
Records indicate that the Committee to Elect Darcey Ladner exceeded the $1,000
threshold on or before September 16, 2023, however, the committee did not file a
2023 35-Day Report by the October 3, 2023 due date. Disclosures were made
later on the 2023 Pre-Election Report filed on October 26, 2023. Because the
disclosures were untimely, the Committee is subject to a civil late filing penalty
under N.C.G.S. § 163-278.34(a). The assessment is enclosed with this letter.
The Committee to Elect Darcey Ladner remains eligible to request a waiver of the
civil late filing penalty for good cause. Information about the waiver process is
enclosed.
